I am retired pharmaceutical research executive and Navy Captain who has been corresponding frequently with Michael Ornelas at Valley State Prison for over three years.

I am writing to request assistance in reducing the life sentence he received under the three strikes law. He has been imprisoned for over 20 years despite the fact that his 1st 2 convictions were as a juvenile for lesser offenses.

I have no knowledge of criminal law but his incarceration does seem excessive. A summary of his incarceration is detailed in his attached letter.

As he mentor, I have noted that Michael has a strong desire to learn, continue his education and in extensive involvement in helping younger prisoners to attain sober drug free lives and in avoiding gang affiliation, involvement and violence. Michael has been effective for beneficial and productive improvements in his prison environment.

We would appreciate your assessment of Michaels sentence and guidance on what should be done or who to contact to get a review.

Letter from Michael:
I have been a prisoner in the California Department of Corrections since 1999. I am forty-six years old and have been incarcerated since I was twenty-five.

In 2000, I was sentenced by a Riverside County Court to two consecutive sentences of twenty-five years to life in under California’s “Three Strikes” statute. In addition the court added another ten years for a prior juvenile felony conviction in 1991 when I was seventeen. Several years later I was convicted four felonies: Carjacking, Second degree robbery, Kidnapping for Robbery and Kidnapping in the course of the Carjacking. The courts found that while there was a “Reasonable Apprehension of Harm” my crimes were perpetrated “without the use of any weapon or physical force”.

My earliest parole date is 2050, but Assembly Bill 1308 extends the youth offender parole for people who were 25 or younger that should have a “Youth Offender Parole Hearings”, based on the “diminished culpability” of youth).

The only BPH hearing available to me is the elderly parole consultation in 2028, and an initial elderly parole board hearing in
2033. My prior juvenile conviction resulted in sixty-year sentence under California’s Three Strikes Law.

The Supreme Court has declared sentences of fifty-years the “functional equivalent of life without the possibility of parole.” The Three Strike statute disqualified me for a youth offender parole hearing. Assembly Bill 1308 exclusions violates three strikers right to equal protection because it excludes Third Strike offenders 25 years or younger, are two groups “similarly situated” serious/violent youth offenders having diminished mental capacity to demonstrate participation in education and rehabilitated program to address the causative factors of crime should rejoin society.
I urgently request your help in correcting my disproportionate sentence or refer me to others that could be of assistance.

Not everyone who enters this place is a low life or a criminal. Very rude officers . If you do not know the procedures or rules expect to be talked to like you are a low life. Accept that they will embarrass you with out hesitation.

Corruption runs deep through the halls of this court house i was denied the right to due process of the law so are half of if not all of the parents who walk this hall .don't get me wrong when i write my review there is plenty of parent monsters who deserve to be there and punished for everything they have done to hurt they're children but that was not the case with me I was merely a easy target in the money making market for CPS of selling off all of our children
from the officers checking you in (you hope and you better double check with them cause they may forget too oh so conveniently) ,the court personnel to the public pretenders the district attorneys the judges and specially the workers even the warrant officers they hurd family's through the system like cattle being sent to their demise there is not laws in this court house not for everyone just us parents or any formal court procedures that the workers have to follow allowed to fill reports with lies and fake test results the judge just takes the workers word for it without thoroughly looking threw or investigating any of the accusations in the reports the judge follows along being manipulated like a puppet in favor of CPS children taken away from families and put in a far more severe situation then they were in before CPS got there money hungry fingers on then the justice department helps hide illegal removals and warrantless seizures helping them to break the laws they put in place for us all to follow .not some times or when they feel like the laws have no days off no week ends or holidays yet the CPS workers do as they please above the law with no one to answer to they break them everyday our constitutional rights don't mean a thing for people like them only people like me and you parents have no voicewould not listen to me when I told them the workers had falsified drug test results that should have been from Riverside community hospital in stead read la county if the public pretender they gave me would have done his job (thanks for nothing brent valdez ) you helped the workers steal my kids and only provided me one visit the entire 18 months my case was open you didnt even let me testify when i told you i would and could handle it if you did you yourself even tried to tell me i had only been to one of the many hearings regarding my kids) just as well as you should have known those tests were not real or that the worker had not even filed a petition with dependency courts until two days after she came to my home trying to steal my kids then they told a story about how they took my children from me at a unknown location and took them to their father at the home we all shared for you did not work for me like you got paid to do you stood right there and allowed them too tear my my family apart to and throwing me to the wolves forcing me to live alone in the streets for 18 months sick with COVID and just after giving birth I'm 36 and a woman with no way out of the streets were riverside county workers put me i have no way out cause that was my only home my only family that they made sure to tear apart and ruin ensuring I stayed in the streets unable to tell anyone what they had done to me and my family i tested positive thc one time during my drug testing yet they painted as a hard core mentally ill druggy and a danger to my childrens health and well being but the only one that was a danger to my children was those workers and that judge who didn't even know wether my children were girls or boys the first option shouldn't be removal when secondary testing at the hands of the hospital was never done someone should have to verify all the information in the reports cause those workers out right lie manipulate falsify and make up stories as they tried to steal my babies and the system failed me and my family and based on a preponderance of evidence what kids of sad joke is that my kids are very well taken care of and had never seen any of life's worries now they won't stop worrying about child protective services showing up trying to steal them
