When the closing on the sale of our property in Paw Paw was repeatedly delayed because of a title issue, we turned to Jason Machnik for help. We were so glad that we did. He assured us that the error in the property description in the deeds that was preventing the title company from issuing a title policy was not a problem at all. He immediately contacted the title company and explained why the property description in the deeds was accurate and that the costly and time consuming "corrective actions" they were proposing were totally unnecessary. He then contacted our buyer and relieved her concerns as well. A few days later, the title policy was issued, and we closed on the sale. There is no doubt, it was Jason's knowledge, responsiveness and professionalism that made all the difference.

I had spoken with Mr. Machnik regarding a lien (intent to file) process. I do not need to hire the firm at this time, since the lien process is in the beginning stages. Plus, Mr. Machnik had suggested a couple ways to resolve the issue out if the court system. Which can save me some money. A big part of our conversation was about the amount fees that would need to pay if I hire him. I like to save money, but I also wish to see if I may be released from both contracts with Ayers Basement Systems. Reason, both projects were not finished in a timely matter. The basement project had been delayed 48 days to complete. The company did not return on there third day scheduled April 29, 2022 to complete their work or to perform the cleanup. They waited 48 day to complete the project, June 16, 2022. The lien issues comes from a driveway contract. I have the contract but I am waiting for the driveway to be completed per contract. The last date that Ayers Basement Systems performed any work on the driveway was June 28, 2022. I continue to reach out to make time to have the driveway completed per contract, but they only want the payment. I have instructed that Ayers will not finished the driveway per contract.

This conversation began at 10am, on 8/25/2022, which was 30 mins earlier than scheduled.

I am the trustee of an irrevocable family trust managed out of the State of California. The trust required the transfer of real property located in Michigan from the trust to an individual living in Michigan. Our California estate attorney recommended that we engage a Michigan attorney with expertise in both Estate Law and Real Estate Law to assist in facilitating this transition.

Because of unique, technical nuances concerning the transfer, the first Michigan {specialist} attorney initially referenced informed me that he would not take up the case. However, he guided me - in no uncertain terms - to go straight to Herbert Machnik Law Firm (HMLF). I did, and this was the very best recommendation that I could have received.

While we had to deal with very technical issues under time-critical deadlines, Ben Herbert took charge and expedited the process to a successful conclusion which met all time constraints associated with the cause.

Mr. Herbert, and the entire HMLF Team with which I communicated from afar, treated me and this personal project as if I was their only client. Mr. Herbert’s intimate knowledge of Estate Law, Real Estate Law, and the local County and City Approval Processes positioned him to layout and prioritize a step-by-step plan in which to guide me…this so that no time or steps would be wasted in the process. This included multiple, technical legal documents needing to be drafted in California but using specific language friendly to the Michigan Trusts, Estates, and Real Estate Laws, the documents of which were then sent to Michigan for final execution. Ultimately, all original goals were met which allowed for the final dissolution of the trust at a critical time for tax planning, and to best serve overall trust beneficiaries’ interests.

Of most importance: Mr. Herbert went overboard in giving his direct attention at every point of critical task execution…personally calling me to assure the proper next steps for maximum accuracy and efficiency of process. And, I must add, Mr. Herbert is an extreme professional and the gentlest of gentlemen. He was a real pleasure with which to do business!
