Auto Younik Inc.

I bought my first car with Auto Younik INC. They made sure that the car I purchased from them was in good condition and working well. I drove it for 2 years with no issues at all…So I decided to buy another used car from them. Once again they did not disappoint!

Nightmare. Below was copied and pasted from our formal complaint to Consumer Protection Office...

-The merchant advertised the car on Facebook marketplace saying "Body and mechanic in very good condition - nothing to do". The merchant presented the car as having no issues, no rust, and ready to drive across Canada (which was the desired use the consumer mentioned to the merchant). The vehicle was purchased that day May 30, 2021 and paid for with Interac E-transfer.

-upon purchase we were provided with a very basic "contract/receipt" which did not include: a label, a permit number issued by the Consumer Protection Office, a contract number, a TVQ number, or a TPS number. These are all violations, some earning a penal infraction.

-Vehicle was brought to a mechanic 4 days after purchase who discovered: rust being concealed by newly installed rocker panels, a very rusted filler neck, a rubber hose for the fuel line (illegal repair). Had the consumer known about these issues, specifically the rust, they would not have purchased the vehicle for the agreed upon price. The true value of the vehicle was estimated to be $1000.00 less than what was paid.

-consumer called merchant to inform him of the issues, which the merchant then requested the vehicle be brought to his own mechanic (garage de Montreal). His mechanic did not see any issues with the vehicle (surprise, surprise). Consumer pointed out the rusted filler neck, to which the merchant refused to acknowledge. The merchant also explained that the vehicle was free of rust because it had just been rustproofed.

-upon insistence of the consumer, the merchant agreed to purchase the part, but not cover the labor or acknowledge the other issues with the vehicle (fuel line, hidden rust).

-Consumer brought the vehicle to yet a 3rd mechanic for another opinion, who confirmed the concealed rust, rusted filler neck, and also pointed out that there was no rustproofing done. The merchant had the vehicle sprayed with black motor oil to further conceal the rust and claimed that as rustproofing. Mechanic also confirmed a valuation of $1000.00 than what was paid.

-the replacement part provided by the merchant was the wrong size, and not the OEM part. Mechanic had to add an extension piece.

-in summary, we believe the merchant to be in violation of sect.156, E) of the CPA for failing to provide a label, sect.219, for false representation regarding the condition of the vehicle in an advertisement, sect.228 for failing to mention important information about the vehicle, and failing to provide a permit number on the contract.
